These Terms of Service ("Terms") govern your access to and use of the DrugCovered website located at drugcovered.com (the "Site"), operated by DrugCovered ("we," "us," or "our"). By using the Site, you agree to these Terms and our Privacy Policy.

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. Continued use of the Site constitutes acceptance of the revised Terms.

2. Estimates Only — Not Medical or Insurance Advice

Plan and formulary data displayed on this Site is sourced from publicly available files published by the Centers for Medicare & Medicaid Services (CMS) and the U.S. Food and Drug Administration (FDA). We make reasonable efforts to keep this data current, but we make no warranties — express or implied — as to the accuracy, completeness, timeliness, or fitness for any particular purpose of any data on this Site.

Data may be:

  • Outdated due to mid-year plan changes, formulary updates, or CMS corrections
  • Incomplete due to data processing limitations

  • DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSSES ARISING FROM YOUR RELIANCE ON PLAN COST ESTIMATES OR OTHER DATA ON THIS SITE
  • LOSSES ARISING FROM PLAN ENROLLMENT DECISIONS MADE BASED ON INFORMATION FROM THIS SITE
  • HEALTHCARE COSTS, MEDICAL EXPENSES, OR OUT-OF-POCKET DRUG COSTS THAT EXCEED OUR ESTIMATES
  • INTERRUPTION OR UNAVAILABILITY OF THE SITE

IN ALL CASES, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100 USD. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

5. CMS Data Attribution

Plan and formulary data is sourced from the Centers for Medicare & Medicaid Services (CMS), a federal agency of the U.S. Department of Health & Human Services (HHS). This data is made available under CMS's publicly accessible data program at data.cms.gov.

DrugCovered is not affiliated with, endorsed by, or sponsored by CMS, Medicare, or any government agency. The CMS data displayed on this Site is used under CMS's public data policy and is provided "as-is" from the source.

Drug name data is sourced from the FDA National Drug Code Directory, a public database maintained by the U.S. Food and Drug Administration at fda.gov.

6. Prohibited Uses

You agree not to use this Site to:

  • Scrape, crawl, harvest, or systematically extract plan or formulary data by automated means without our express written consent
  • Reproduce, republish, or redistribute our content or data for commercial purposes without attribution and permission
  • Impersonate any person, entity, or Medicare official
  • Submit false, misleading, or fraudulent information via contact forms or other input fields
  • Attempt to gain unauthorized access to any portion of the Site or our servers
  • Use the Site in any way that violates applicable federal, state, or local laws or regulations
  • Transmit spam, malware, or any harmful code
  • Use the Site to solicit Medicare beneficiaries for insurance products in violation of CMS marketing guidelines

We reserve the right to block access to any user or IP address that violates these prohibitions.

The DrugCovered website, design, logo, and original content (excluding CMS/FDA public data) are the property of DrugCovered and are protected by copyright and other intellectual property laws. You may not reproduce or distribute our original content without written permission.

CMS and FDA data displayed on this Site is U.S. government public domain data and is not owned by DrugCovered.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the applicable laws of the state in which DrugCovered is operated, without regard to conflict of law principles.
